When Kitty is explaining to Watson the details of the trial of Eli Kotite, she says that the Magistrate who oversaw the trial was killed in a car accident. Holmes states Kotite was given a 4 year prison sentence. A Magistrate, in the English legal system, is a lay person, someone who is not a judge and who is not paid. Magistrates only preside over cases heard in Magistrate courts and they can only sentence someone to a maximum of 6 months in prison. Causing death by dangerous driving, which is the likely charge Kotite would have faced, is an indictable only offence. As such, the trial would have to have been heard in a Crown court. All cases heard in a Crown court are heard by a Judge, not a Magistrate.
