- GoofsA person taken into custody on a material witness warrant is not sent through booking, nor do they have a bail hearing, not unless they are also being charged with a crime. In this instance the wife is just being held as a witness, she is not being charged with a crime. When someone is taken into custody as a witness it is done for their own protection, they are not held in a jail cell, they are put up in a motel room with a police escort. ADA Carver threatening the wife with not receiving bail and going to Riker's Island makes no sense at all.

"I don't know whether to laugh or cry"
Really like 'Law and Order: Criminal Intent' on the whole, if more the earlier seasons than the later ones. "But Not Forgotten" struck me as a great episode on my first watch when getting into the show, despite a couple of parts needing more clarity on that viewing. The premise was a fascinating one and the title sounds very poetic and bittersweet on its own. Also liked the previous three episodes of a generally solid Season 3, "Undaunted Mettle" faring best.
"But Not Forgotten" got better with each subsequent watch, a further three times over-time, and still is a great one. It is not quite perfect, but "But Not Forgotten" is to me one of the better episodes of the season's first half, one of the better episodes of the season and the first outstanding Season 3 episode. After the first two being very good and a good if slightly bland previous one, so definitely a step or two in the right direction.
There is so much good here, but a big advantage is the great acting from all the leads. Cannot fault Vincent D'Onofrio, always a big part of the show's appeal and its heart basically and he is delightful. Courtney B. Vance also shines, shining the most he has in a while, especially when very aptly describing the case as operatic.
Moreover, there is lovely witty interaction between all the characters, nothing static here. The whole coversation regarding coffee and dogs is priceless. The story is very eventful and is very clever and twisty, complicated but mostly not too difficult to comprehend.
Production values are slick and appropriately gritty, like the original 'Law and Order' and 'Special Victims Unit' the editing had become smoother and tighter by this point. The music fitted quite well, both in tone and how it was placed. The ending is surprising and beautifully done. Goren always fascinates.
Did at times find the story slightly muddled in the middle. The accent is also distractingly horrible.
Overall, outstanding, the first episode of the season to be. One of the best episodes of Season 3. 9/10
