Max tells the Chief that he knows the Chief would never fire him because seniority dictates that Larabee would move up into his position. However, early episodes established Max as head of the agents section, acting chief, and a strong contender to eventually replace the Chief, indisputably one of the highest-ranking agents in CONTROL. That Larabee, who is essentially the Chief's secretary, should be first in line to replace the putative second-in-command is ludicrous, even in an agency as rife with lunatics and incompetents as CONTROL.
When DeGrasse is watching Max prune the tree, there is obviously a large amount of foliage still on the tree. By the time he walks over to Max, the tree is completely bare, far more pruning than Max could have accomplished in a few seconds.
DeGrasse is shown watering the lawn in his office from a three-foot tall blue water spigot permanently installed in the office floor. However, when DeGrasse was interviewing Max, it was nowhere to be seen.
When Hathaway finds 86 cutting the fence, Max has a briefcase with a flashlight and a (lit) acetylene torch inside it. However, when he leaves Hathaway, it is nowhere to be seen. Leaving a case with such supplies, and possibly more, behind for KAOS to find would remove any doubt that CONTROL had infiltrated DeGrasse's nursery.
