Bill Cosby could be back in court soon fighting over the overturning this past summer of his 2018 rape conviction as Pennsylvania prosecutors appealed to the Supreme Court of the United States. Lashing out against the so-called “#metoo mob” in response and tongue lashing the “pathetic last-ditch effort” by the Montgomery County’s District Attorney The Cosby Show creator certainly isn’t taking the high road to the High Court.
“The Pennsylvania Supreme Court’s expansion of the Due Process Clause goes far beyond anything contemplated by this Court,” says the petition for a writ of certiorari filed on November 24 to beat today’s Scotus deadline (read it here).
“Because it construes the federal constitution, it is poised to transform similar decisions not to prosecute into effective grants of immunity in other states,” the 33-page filing states. “At the least, it presages extensive litigation of such claims nationwide, particularly in light...

If anyone thought a now-free Bill Cosby was going to lay low for a bit after having his rape conviction and sentence suddenly overturned last week, think again. The much-accused actor once known as “America’s Dad” chose America’s Independence Day to prove them wrong.
In a somewhat confusing, scattered statement today, Cosby lashed out at Howard University’s rebuke of his former on-air spouse Phylicia Rashad after her enthusiasm at the disgraced actor’s release from prison. Going from bad to worse, Cosby also decried the bloody attempted coup at the Capitol in January as the fault of the mainstream media, and not Maga morons. It was not a good look, to put it mildly, for the 83-year-old once legally labeled “sexually violent predator.”
“Howard University you must support ones Freedom of Speech (Ms. Rashad), which is taught or suppose to be taught everyday at that renowned law school,...

Update, 3:30 Pm Pt: Bill Cosby had nothing to say in front of the cameras just over an hour ago today after his rape conviction and prison sentence was overturned by the Pennsylvania Supreme Court. However, the now freed and much-accused actor, or someone in his camp, just took to social media to speak out.
In a strident and distinctly heavy handed tweet, the man one praised as “America’s Dad” took a self praising digital victory lap.
I have never changed my stance nor my story. I have always maintained my innocence.
Thank you to all my fans, supporters and friends who stood by me through this ordeal. Special thanks to the Pennsylvania Supreme Court for upholding the rule of law. #BillCosby pic.twitter.com/bxELvJWDe5

Rashad wrote, “I fully support survivors of sexual assault coming forward. My post was in no way intended to be insensitive to their truth. Personally, I know from friends and family that such abuse has lifelong residual effects. My heartfelt wish is for healing.”

Updated with prison release: Bill Cosby has been released from prison after the Pennsylvania Supreme Court overturned his 2018 sexual assault conviction, finding fault with the way prosecutors pursued a case against him after earlier declining to file charges.
Pennsylvania Department of Corrections spokesperson Maria Bivens said in a statement just before 3 p.m. Et that the actor-comedian “has been released.” The state Supreme Court said Cosby, 83, cannot be retried on the same charges, though there is the potential that the overturn opinion could be appealed to the U.S. Supreme Court. But it’s highly that the nation’s highest court would even take the case.
Cosby was sentenced to three to 10 years in prison, and has been serving time at Pennsylvania’s State Correctional Institution at Phoenix. He had been found guilty in his second trial for the 2004 rape of former Temple University employee Andrea Constand. Cosby, 83, has maintained...

Days after deep-sixing Donald Trump’s latest lunge to overturn the 2020 presidential election, Pennsylvania’s Supreme Court on Tuesday took up Bill Cosby’s Hail Mary appeal of his 2018 rape conviction.
With some minor technical glitches, this morning’s about 80-minute virtual hearing came down to prior bad acts, invoking 5th amendment rights, and a 2005 press release from the prior D.A. of the Keystone State’s Montgomery County.
In a gathering that saw the likes of brisk Chief Justice Thomas Saylor staring off camera at times, the hearing started with defense attorney Jennifer Bonjean ripping into the current Montgomery County D.A.’s office for its successful prosecution two years ago of the now-imprisoned Cosby for sexually assaulting Andrea Constand.
Her much accused client “never had a fair shot,” Bonjean declared, with emphasis on trial judge Steven O’Neill permitting five other women to take the stand in the case...

The Pennsylvania Supreme Court seemed deeply skeptical on Tuesday about whether five women should have been allowed to testify against Bill Cosby during his sexual assault trial.
Cosby is serving a three-to-10 year sentence for sexually assaulting Andrea Constand in 2004. In his appeal, his attorneys have argued that the judge should not have allowed the five other witnesses to tell jurors about their own accusations against the comedian.
The state Supreme Court heard arguments in the case on Tuesday morning. Several of the justices seemed troubled by the witnesses’ testimony, saying it may have unfairly influenced the jury.
“I tend to agree this evidence was extraordinarily prejudicial to your client,” said Justice Max Baer, speaking to Cosby’s attorney.
The case involves a key element of #MeToo trials — the use of “prior bad acts” witnesses to support the testimony of the alleged victim. Such witnesses were also used in Harvey Weinstein’s trial.

After almost two years in state prison for the 2004 rape of Andrea Constand, Bill Cosby will get to argue part of his case before the Supreme Court of Pennsylvania in an appeal granted Tuesday.
Having failed on almost a dozen occasions to have the matter reopened or re-litigated, this limited review does present the officially designated sexually violent predator once known as America’s Dad with the best opportunity to be free since he was sentenced in September 2018 to up to a decade behind bars. While no date has been set due to the ongoing coronavirus pandemic, the appeal could also put the Montgomery County D.A.’s office and Cosby trial(s) Judge Steven O’Neill under the legal microscope.
Specifically, the appeal will look at two potentially mitigating aspects of the case, which had initially resulted in a mistrial due to a hung jury. Pennsylvania’s Supreme Court will...

Bill Cosby has just filed legal docs railing on the trial judge in his sexual assault case for not giving him bail pending appeal, and claims the judge had a personal vendetta against a key defense witness. Cosby's lawyers claim Judge Steven O'Neill was brutal toward Bruce Castor, the former District Attorney who investigated the case back in 2005. Cosby claims Castor gave him assurances when he was D.A. that he would not be prosecuted...

14 years and two trials later, Andrea Constand has spoken at the sentencing of Bill Cosby. As the television star awaits Montgomery County Court Judge Steven O'Neill's decision regarding his sentencing, Constand addressed the court in Morristown, Pa. on Monday during the first day of his sentencing hearing. Hours earlier, she took to social media, citing a Bible passage. "Be wrathful, but do not sin; do not let the sun set while you are still angry; do not give the Devil an opportunity. Ephesians 4: 26," Constand tweeted early Monday. By the afternoon, she had briefly taken the stand. "I testified...[The] jury heard me," Constand said. "All I am asking...

Bill Cosby won't get a shot at relitigating his criminal case before a different judge and is due to be sentenced next week following his conviction for a 2004 aggravated sexual assault of Andrea Constand.
Cosby earlier this month attempted to reset the case to its early stages, asking Judge Steven O'Neill to recuse himself and overturn a key February 2016 ruling in which he found that Cosby's due process rights weren't being violated in prosecuting him despite an alleged nonprosecution agreement from then-Montgomery County District Attorney Bruce Castor.
